Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of heropfc.com (the “Site”) and your interactions with H.E.R.O. Performance Coaching (“H.E.R.O.,” “we,” “us,” or “our”).
 

H.E.R.O. Performance Coaching is a personal training and fitness coaching business operated by Louis Gorshe in San Francisco, California.
 

By using the Site, submitting an inquiry, or scheduling a consultation through the Site, you agree to these Terms.

1. About H.E.R.O. Performance Coaching

H.E.R.O. provides services that may include:
 

  • One-on-one in-person personal training;

  • Online fitness coaching;

  • Resistance-training programming;

  • Nutrition coaching; and

  • Hybrid combinations of in-person and online coaching.
     

Specific services, pricing, schedules, cancellation terms, and other conditions applicable to an individual client may be governed by a separate client agreement, waiver, informed-consent document, or other agreement.
 

If these Terms conflict with a separately executed client agreement concerning paid coaching services, the terms of that client agreement will control with respect to those services.

2. Fitness and Educational Services — Not Medical Care

Information provided through the Site and H.E.R.O.’s fitness and coaching services is intended for fitness, wellness, and educational purposes.
 

H.E.R.O. does not provide medical diagnosis, medical treatment, physical therapy, psychotherapy, or other licensed healthcare services unless expressly stated otherwise and provided by an appropriately licensed professional.
 

References on the Site to injury prevention, rehabilitation experience, nutrition, wellness, or similar subjects do not constitute medical advice or establish a healthcare-provider relationship.


You should consult an appropriate qualified healthcare professional regarding medical conditions, injuries, symptoms, medications, dietary restrictions, or concerns about your ability to participate safely in physical activity.

3. Client Responsibility and Physical Activity

Exercise and physical training involve inherent risks, including the possibility of injury.


You are responsible for providing accurate and reasonably complete information about health conditions, injuries, physical limitations, medications, or other circumstances that could materially affect your ability to participate safely in fitness activities.
 

You are also responsible for:
 

  • Following reasonable safety instructions;

  • Using equipment appropriately;

  • Informing your coach promptly of pain, injury, illness, dizziness, unusual symptoms, or material changes in your health;

  • Obtaining medical clearance when advised by an appropriate healthcare professional or reasonably requested before participating in particular activities; and

  • Exercising reasonable judgment regarding your own physical condition.
     

Participation in H.E.R.O.’s services does not guarantee any particular fitness, health, weight, strength, performance, or other outcome.
 

These Terms are not intended to replace any separate liability waiver, assumption-of-risk agreement, or informed-consent document used for training services.

4. Nutrition Coaching

Any nutrition information or coaching provided by H.E.R.O. is intended for general fitness, wellness, and educational purposes within the scope of the services H.E.R.O. is qualified to provide.
 

Unless expressly provided by an appropriately licensed healthcare professional, nutrition coaching is not medical nutrition therapy and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
 

Clients with medical conditions, allergies, eating disorders, significant dietary restrictions, or other health concerns should consult an appropriately qualified healthcare professional.

5. Scheduling, Payments, Cancellations, and Refunds

Appointments and consultations may be requested or scheduled through the Site or through third-party scheduling services.
 

Pricing, payment schedules, cancellation requirements, rescheduling policies, package expiration dates, refunds, and other commercial terms may vary by service and will be communicated at or before purchase.
 

Where a separate client agreement, booking confirmation, or refund/cancellation policy applies, those terms form part of the agreement governing the applicable service.
 

The Site’s current Refund Policy should be reviewed before purchasing services.

6. Intake and Consultation Requests

Submitting an inquiry, intake form, or consultation request does not obligate H.E.R.O. to accept you as a client and does not by itself create a trainer-client relationship.
 

H.E.R.O. may determine that a requested service is outside its scope, that additional information or medical clearance is appropriate, or that another provider would better meet a prospective client’s needs.

7. Privacy

Our collection and use of personal information through the Site is described in our Privacy Policy.
 

Because fitness services may require information concerning injuries, physical limitations, health conditions, or similar matters, please review the Privacy Policy before submitting an intake form or other health-related information.

8. Website Content

Unless otherwise indicated, text, graphics, branding, photographs, videos, training materials, and other original content appearing on the Site are owned by or licensed to H.E.R.O. Performance Coaching and are protected by applicable intellectual-property laws.
 

You may use the Site and its content for your personal, noncommercial use. You may not reproduce, distribute, sell, modify, republish, or commercially exploit Site content without permission from H.E.R.O. or the applicable rights holder.

9. Acceptable Use

You agree not to:
 

  • Use the Site for unlawful or fraudulent purposes;

  • Attempt to gain unauthorized access to the Site or systems supporting it;

  • Interfere with the Site’s operation or security;

  • Submit false, misleading, malicious, or unlawful information;

  • Use automated means to access the Site in a manner that materially interferes with its operation; or

  • Infringe the rights of H.E.R.O. or any third party.

10. Third-Party Services and Links

The Site may use or link to services operated by third parties, including Wix, scheduling providers, payment providers, social-media platforms, and coaching or client-management services.
 

H.E.R.O. does not control third-party services and is not responsible for their availability, content, security, terms, or privacy practices. Your use of a third-party service may be subject to that provider’s own terms and policies.

11. No Guarantee of Website Availability

We strive to keep the Site accurate and available, but we do not guarantee that it will always be uninterrupted, error-free, complete, or current.
 

Site content may be updated, modified, corrected, or removed without notice.

12. Disclaimer of Warranties

To the extent permitted by applicable law, the Site and its general informational content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.


Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

13. Limitation of Liability

To the fullest extent permitted by applicable law, H.E.R.O. will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from your use of or inability to use the Site.
 

Nothing in these Terms is intended to waive or limit liability that cannot lawfully be waived or limited.
 

Liability, assumption of risk, and related terms applicable to participation in personal training or coaching services may be addressed separately in the applicable client agreement and waiver.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold H.E.R.O. harmless from claims, liabilities, damages, or expenses arising from your unlawful misuse of the Site or your material violation of these Terms.
 

This provision does not limit rights or remedies that cannot lawfully be limited.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
 

Any dispute concerning these Terms or use of the Site will be subject to the jurisdiction of courts of competent jurisdiction in California, except where applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms periodically to reflect changes in the Site, our services, or applicable requirements.
 

The effective date at the top of this page identifies the most recent version. Continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
